Terms of Sale

The offer and sale of products on our website ("dudubags.com") are governed by these General Terms of Sale. You can request any information through our assistance services by contacting Customer Service. If you need further information, go to the Contacts area. You will find information regarding orders and shipments, refunds, and the return of products purchased on dudubags.com. 1. Our commercial policy

1.1

The Seller offers for sale, on dudubags.com, products and carries out its e-commerce activity exclusively towards its end users who are "consumers".

1.2

When we talk about "consumer" we refer to any natural person acting on dudubags.com for purposes not related to their commercial, entrepreneurial, or professional activity, if any. If you are not a "consumer", we invite you to refrain from concluding commercial transactions on dudubags.com and to contact support.info@dudubags.com.

1.3

Considering its commercial policy, the Seller reserves the right not to proceed with orders from parties other than the "consumer" or in any case with orders that do not comply with its commercial policy.

1.4

These General Terms and Conditions of Sale exclusively regulate the offer, submission, and acceptance of purchase orders for products on dudubags.com between dudubags.com users and the Seller.

1.5

The General Terms and Conditions of Sale do not regulate the supply of services or the sale of products by parties other than the Seller who are present on dudubags.com through links, banners, or other hyperlinks. We recommend that before placing orders and purchasing products and services from parties other than the Seller, you verify their sales conditions, because the Seller is not responsible for the supply of services by third parties other than the Seller or for the conclusion of e-commerce transactions between dudubags.com users and third parties.

2. How to conclude the contract with the Seller

2.1

To conclude the purchase contract for one or more products on dudubags.com, you must fill out the order form electronically and send it to the Seller electronically, following the related instructions.

2.2

The order form contains a summary of information on the essential characteristics of each ordered product and the related price (including all applicable taxes or duties), the payment methods you can use to purchase each product, the delivery methods of the purchased products, and the shipping and delivery costs.

2.3

The contract is concluded when the Seller receives your order form electronically, after verifying the correctness of the data related to your order.

2.4

The order form will be stored in the AWS database, located in Hessen - Frankfurt Am Main (Germany), for the time necessary to fulfill the orders and in any case within the legal terms.

2.5

Before proceeding with the transmission of the order form, you will also be asked to identify and correct any data entry errors.

2.6

The language available to conclude the contract with the Seller is Italian.

2.7

Once the contract is concluded, the Seller will take charge of your purchase order.

2.8

The Seller may refuse to process your purchase orders that do not provide sufficient solvency guarantees or that are incomplete or incorrect, or in case of product unavailability. In these cases, we will inform you by email that the contract is not concluded and that the Seller has not proceeded with your purchase order, specifying the reasons. If the products presented on dudubags.com are no longer available or for sale at the time of your last access to the site or the submission of the order form, the Seller will promptly notify you, in any case within thirty (30) days from the day following the day you sent your order to the Seller, of the possible unavailability of the ordered products. In case of submission of the order form and payment of the price, the Seller will refund the amount you have already paid.

2.9

By electronically submitting the order form, you unconditionally accept and commit to observe, in relations with the Seller, these General Terms and Conditions of Sale. If you do not agree with some of the terms stated in the General Terms and Conditions of Sale, we invite you not to submit the order form for the purchase of products on dudubags.com.

2.10

By submitting the order form, you confirm that you know and accept the General Terms and Conditions of Sale and the additional information contained on dudubags.com, also referenced via links, including the General Terms of Use and the Information on the Right of Withdrawal.

2.11

Once the contract is concluded, the Seller will send you, by email, a receipt of the purchase order, containing the information already included in the order form (information relating to the essential characteristics of the product and the detailed indication of the price, payment methods, your right of withdrawal, and delivery costs).

3. Guarantees and indication of product prices

3.1

On dudubags.com, only products bearing the trademarks owned by the Manager such as DuDu®, Nuvola Pelle®, Antica Toscana®, Novelty®, dv® and other trademarks distributed by the manager with authorization from the fashion house are offered for sale.

3.2

The Seller does not sell used, irregular, or lower quality products than the corresponding standards offered on the market.

3.3

The essential characteristics of the products are presented on dudubags.com within each product sheet. However, the images and colors of the products offered for sale on dudubags.com may not correspond to the real ones due to the Internet browser and monitor used.

3.4

Product prices may be subject to updates. Make sure of the final sale price before submitting the related order form.

3.5

Purchase requests from countries not included among those displayed on the splash page cannot be accepted by the Seller.

3.6

All products are equipped with an identification tag. We ask you not to remove the tag from the purchased products, of which they are an integral part.

3.7

The Seller, in case of exercising your right of withdrawal, has the option not to accept the return of products that are missing the related tag or that have been altered in their essential and qualitative characteristics or that have been damaged.

4. Payments

4.1

For payment of the price of the products and the related shipping and delivery costs, you can follow one of the methods indicated in the order form.

4.2

In case of payment by credit card, financial information (for example, credit/debit card number or its expiration date) will be forwarded, via encrypted protocol, to PayPal Pro, which provides the related remote electronic payment services, without third parties being able to access it in any way. Furthermore, such information will never be used by the Seller except to complete the procedures related to your purchase and to issue the related refunds in case of any product returns following the exercise of your right of withdrawal, or if it becomes necessary to prevent or report fraud to the police forces on dudubags.com. The price for the purchase of the products and the shipping costs, as indicated in the order form, will be charged to your bank account at the time of shipment of the purchased products.

5. Shipping and delivery of products

To learn about the specific shipping and delivery methods of the products, access the Shipping section. Please pay attention to what is reported in this section because the indications contained therein form an integral and substantial part of these General Terms and Conditions of Sale and, therefore, are considered by you to be fully known and accepted at the time of submitting the order form.

7. Right of withdrawal

7.1

You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (30) days from the day of receipt of the products purchased on dudubags.com. It is not possible to exchange the chosen product for another. No refunds or replacements are provided for personalized products.

7.2

In case of withdrawal, you must return the products to the Seller by handing them over to the courier for shipment within fourteen (14) days from when you communicated your decision to withdraw to the Seller.

7.3

National returns are free of charge. There will be no costs to you.

7.4

After receiving the returned order, the cost previously incurred for delivery of the purchased products to your home will also be refunded; however, you will remain responsible for any loss or damage to the products during transport.

7.5

The Right of Withdrawal – in addition to respecting the terms and methods described in the previous points 7.1, 7.2, 7.3, and 7.4 – is considered correctly exercised when the following conditions are also fully met:

Returns are accepted only after opening a return case directly through the website with the related RMA procedure or communication via email to the Seller; products must not have been used, worn, washed, or damaged; the identification tag must still be attached to the products as it is an integral part of the item; products must be returned in their original packaging; returned products must be delivered to the carrier within fourteen (14) days from the date you communicated your decision to withdraw to the Seller; refunds or replacements are not provided for personalized products.

7.6

If the Right of Withdrawal is exercised following the methods and terms indicated in this paragraph 7, the Seller will refund any amounts already received for the purchase of the products according to the methods and terms provided.

7.7

The amounts will be refunded to you as soon as possible and, in any case, within fourteen (14) days from the date the Seller became aware of your exercise of the right of withdrawal. We will activate the refund procedures once the correct execution of the terms and conditions indicated above has been verified, as stated in paragraph 8. 7.10 If the methods and terms for exercising your right of withdrawal, as specified in this paragraph 7, are not respected, you will not be entitled to a refund of the amounts already paid to the Seller; however, you may recover the products at your own expense in the condition in which they were returned to the Seller. Otherwise, the Seller may retain the products, in addition to the amounts already paid for their purchase.

8. Times and methods of refund

8.1

After the return of the products, the Seller carries out the necessary checks regarding their compliance with the conditions and terms indicated in paragraph 7. If the checks are positive, the Seller will send you, by email, the confirmation of acceptance of the returned products.

8.2

Whatever payment method you used, the refund is activated by the Seller as soon as possible and in any case within fourteen (14) days from the date the Seller became aware of your exercise of the right of withdrawal, after verifying the correct execution of your right of withdrawal and acceptance of the returned products.

8.3

If there is no match between the recipient of the products indicated in the order form and the person who made the payment for their purchase, the refund of the amounts, in case of exercising the right of withdrawal, will be made by the Seller, in any case, to the person who made the payment.

8.4

The value date of the refund is the same as the debit; consequently, you will not suffer any loss in terms of bank interest.

8.5

At the time of return you must personally pay the necessary expenses and you will be responsible for any loss or damage to the products during transport, according to the methods and terms provided for exercising the right of withdrawal.

9. Privacy

9.1

You can obtain information on how we process your personal data by accessing the Privacy Policy.

9.2

We also ask you to read, if you have not already done so, our General Terms of Use because they contain important information on how we handle our users' personal data and on the security systems adopted.

10. Applicable law and dispute resolution

10.1

The General Terms and Conditions of Sale are governed by Italian law and in particular by Legislative Decree 6 September 2005 no. 206, on the consumer code, with specific reference to the regulations on distance contracts and by Legislative Decree 9 April 2003 no. 70 on certain aspects concerning electronic commerce.

10.2

ADR - According to article 49 paragraph 1 letter V of Legislative Decree 6 September 2005 no. 206 (Consumer Code) the customer may use the Paritetic Conciliation procedure. The procedure can be initiated if the consumer, after having submitted a complaint to the company, has not received a response within 45 days or has received a response that they do not consider satisfactory.

10.3

ODR - Pursuant to art. 14 of Regulation 524/2013, the user is informed that in case of dispute they may submit a complaint through the European Union's ODR platform accessible at the following linkhttp://ec.europa.eu/consumers/odr/. 11. Modification and update
